Does the compassionate leave right of an employee whose wife gave birth on an official holiday start after this holiday? (In Turkey)
The wife of an employee working at one of our customers gave birth on August 10, Saturday. The next day (August 11, Sunday) the Eid al-Adha began. The employee claims that he should take paid leave on the occasion of his wife’s situation. We also said that his wife had already given birth on the day the company did not work, and that he had already spent these days with his wife and child and that we could not allow him to take this paid leave. Which one is true? What is the implementation of this situation?
Compassionate Leave – ADDITIONAL ARTICLE 2 – “The employee shall be granted paid leave for three days in case of marriage or adoption or death of his/her parents, spouse, brother/sister and child; and for five days if his wife gives birth…”. Therefore, this worker who wants to take compassionate leave, cannot claim this right as well.
