For foreign persons who have obtained a work permit, social security premiums must be paid in full at the rate declared to the Ministry.

It is necessary to be accepted that the type of employment contracts of foreign employee with social security employed based on the document that is valid with the deadlines specified in the Law and the relevant implementation regulation and the applications made to the specified Institutions, is a fixed term and full-term service contract.

Therefore, when applying for a work permit, a partial employment contract is not issued for a foreigner who has been granted a work permit for a full-time period of 1 year or more, and it is not possible to show a reason for the missing day. Thus, among the reasons of the missing days, the code (6) and the partial employment reason for the foreigners will not be shown and due to this reason, the missing days will not be notified.

1.1-
 Office rent, no matter how much it costs, SHOULD BE PAID VIA BANK.
1.2- House rent, if it is 500 TL and more, SHOULD BE PAID VIA BANK.

House rents which cost less than 500 TL can be paid cash if it is wished. That obligation is applied separately to each house rent. Such as, if you have rental income from 10 different houses and the rent of 5 houses is 450 TL for each. So, if you wish, you may collect them in cash.

2- Since When Has This Rule Been Applied?
This rule has been applied as of the date of 01 November 2008.

3- How Can I pay it Except from Bank?
The collection of revenues and payments can be made via BANK or PTT as of the date of 1.11.2008.

4- Is There Any Rent Which is not paid via Bank?
The rents which are not supposed to be paid via bank are listed below:
4.1- Housing rents valuing at less than 500 TL,
4.2- Collection of revenues from house and office rents by means of execution and court,
4.3- On the other hand, rental payments in kind are also not within the scope of this obligation.

5- I Didn’t Pay the Rent via Bank! What is the Penalty?
The penalty for not obeying this rule shouldn’t be less than the amount stated below and it should be 5% of the amount applied to each transaction. The minimum amounts of penalties are listed below according to their obligation type.
5.1- 1.370 TL for the first class merchants and self-employed.
(Bookkeepers on the basis of balance and bookkeepers for self-employment income)
5.2- 690 TL for second-class merchants, farmers who are bookkeepers and people whose earnings are based on simple basis. (Operating Ledger, Simple Entry)
5.3- 340 TL for people apart from these. (People who do not have perpetual tax obligation, Housewives, Retiree, Officer, Worker etc.)

Each transaction will be fined separately. That means if the rent should be paid via bank but not paid; the leaser and the leaseholder will be fined separately for 4 months.

According to the Labor Law no. 4857, article no. 44 deciding on working conditions in national holidays and festivals; whether working in festivals or national holidays depends on collective labor contract or labor contracts.
2- If there is no condition in the labor contract how will working be like?
Employer’s will is necessary for working if it there is no condition in labor contract regarding working on national holidays or in festivals.
3-To which criteria payment is made on national holidays or in festivals?
Payment is made to the labors working in the places within the scope of Labor Law no. 4857.Without being in return of a work, full payment is made
– If they work without having holiday, full payment and  working day payment  made.
– Employee’s wage is paid by the employer in national holidays or festivals.

Regarding apprentices, apprentice candidates and the students getting vocational education, in case of job accident and vocational disease, health insurance  and  while studying in vocational schools, the students who are supposed to do internship and who work part time  are executed  job accident and vocational  disease  insurance when monthly premium income is not 30 times more than daily premium income.

Those who are considered as having social security on the status of service agreement and general health insurance are executed to general health insurance articles if they are not responsible for  taking care of anyone.
Moreover; Self-employed workers who are working on behalf of themselves considered as having social status as public agents, will be considered as having social security at the age of 18.

According to the articles of Turkish Civil Code, It is not necessary for those who graduated from vocational school or art school, to be older than 18 to be considered as having social security status.

The children who are younger than 15 years old are not allowed to be worked.
However, if they are at the age of 14 and completed their elementary education, are allowed to work on light duty, on the condition that their physical, psychological and moral developments and educational lives are not restricted.
